Acceptance of Terms

By accepting these terms of service (“Terms”) or by accessing or using the Service, You acknowledge that you have read, understood, and agree to be bound by these Terms. If You are entering into these Terms on behalf of a company or other legal entity, You represent that You have the authority to bind such entity to these Terms, in which case the terms “you” or “your” shall refer to such entity. If You do not have such authority, or if you do not agree with these Terms, You must not accept these Terms and may not use the Service.

Changes to Terms

We may update and change the Terms from time to time without notice. Any new features or tools shall be considered part of the Service and subject to the Terms. Continued use of the Service after any such changes shall constitute your consent to such changes.

General conditions

You agree not to use the Service in any unlawful manner or in any manner that interferes with or disrupts the integrity or performance of the Service and its components. You understand that the technical processing and transmission of the Service, including your data, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices and (c) transmission to our third party vendors and partners who provide the necessary hardware, software, networking, storage, and related technology required to run the Service. You agree not to reproduce, sell, or exploit any portion of the Service, use of the Service, or access to the Service without our express written permission. Any neglect or failure by us to enforce any of these Terms shall not be construed as a waiver or variation of these Terms or otherwise prejudice any of our rights under them.

Disclaimer & Limitation of Liability

The service is provided on an “as is” and “as available” basis without any warranties of any kind, to the fullest extent permitted by law. We expressly excludes any and all warranties, whether express or implied, whether by common law, statute, trade usage, course of dealings or otherwise. You acknowledge that we do not warrant that the Service will be uninterrupted, timely, secure, error-free or virus-free and no information or advice obtained by you from us or through the Service shall create any warranty not expressly stated in these Terms. Under no circumstances, whether in contract, tort, or otherwise, shall we be liable to you or any third party for any direct or indirect damages (including lost profits, lost sales or business, lost data or business interruption) totalling more than your payment for the Service, or £10, whichever is the greater. However, nothing in these Terms shall be taken to limit or exclude either party’s liability for any act or omission for which the exclusion or limitation of liability is prohibited by law.

Payments & Pricing

The Service is billed on a per-survey basis and payments are non-refundable. Surveys are free to setup, but to access the full survey results you need to pay the upgrade fee.

Jurisdiction

These Terms shall be governed by and construed in accordance with English law. Any dispute arising out of use of the Service shall be subject to the jurisdiction of the English courts.

Privacy

General

When you visit our website, your computer sends non-identifying information to our servers so that it knows how to serve you (for example, it will tell us what type of web browser you use). We use this data in aggregate to help plan our business (for example, "5% of our visits last month were from people using iPads").

When you create an account you provide basic identifying information such as your name, school name and email address. We use this to allow you to login to your account and so we can address you by name if you need assistance. We may also link your school name to publicly-available information, so that we can understand what type of school you represent, for example.

Email

You need to provide your email address to us when you create an account, make a comment on our blog or sign up to our newsletter. We won't sell your email address under any circumstances. You can ask us to stop sending you email at any time.
We use a separate marketing agency to send some marketing emails, using an opt-in database that the agency has created. We have completed a legitimate interest assessment regarding this. Email recipients can easily opt-out, and the agency proactively removes out- of-date contacts.

Billing

When you make a purchase, your billing information (credit card number, etc.) is handled by Stripe. We know from Stripe whether you paid or not but we don’t see, and cannot access, your full credit card or bank details.

Cookies

We receive reports from our advertising partners (e.g. Google) about how many people click on our advertisements, and how many of these people eventually go on to make a purchase. And we track which web pages are of most interest to our customers. Our advertising partners (e.g. Google or Facebook) may also use cookies to identify you when you visit other websites to show our advertisements to you. All this relies on cookies, which you can turn off in your browser if you wish.
